Terms & Conditions for buying goods online

In these Terms & Conditions

Ordering
Please see our placing an order online section for instructions on how to order.
By completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Please note orders will only be despatched once we have authorisation from your payment card issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorised.
Certain steps must be followed for a contract to be formed, as described below. After you have placed your order:
- We will send you, as soon as possible, an email to acknowledge your order. It will confirm which goods you have ordered. This email is not an order acceptance from us.
- When we despatch your goods from the warehouse, we will send you a confirmation email. This means we formally accept the order, and are obliged to complete the contract.
We do not have to accept your order, and for example, we will not accept your order if:
- we do not have the goods in stock
- your payment is not authorised
- there is an error on our website regarding the price or other details of the goods
- you have cancelled it in accordance with the instructions below
We reserve the right to refuse any order.
Cancelling an order before despatch
If you change your mind after placing an order, you can cancel it at any time before we despatch it. Please telephone us to cancel your order. You will need to give us your name and address details, as well as your order number.
If you cancel part of an order, the postage and packaging charge is recalculated on the price of the goods you keep. For example, if your order is for £75 worth of goods and you then cancel a £30 item, your order total will drop below £50, and you will no longer qualify for free Standard delivery.
Cooling off period
Items purchased between Sunday 2 November and Wednesday 24 December can be refunded or exchanged up to Saturday 31 January. Normal conditions apply.
When you order from us online, you are entitled to a cooling off period after despatch, when you can return your goods without any penalty. Our cooling off period is 30 days, which includes any statutory cooling off period.
This period starts the day the contract is agreed (i.e. you receive an email from us saying we have despatched your order) and ends 30 days after the day following delivery of the goods.
Certain items are excluded from the cooling off period guarantee, unless we are at fault. These are personalised or engraved items.
Returning goods
Items purchased between Sunday 2 November and Wednesday 24 December can be refunded or exchanged up to Saturday 31 January. Normal conditions apply.
Please refer to our Returns & exchanges section for details of how and where to return goods.
If you wish to return goods, you have a duty to keep them in your possession and to take reasonable care of them until you return them. Please telephone us on 0845 602 1112* if you would like to return your order and we will send you pre-paid labels so that you can return them for free. Goods must be returned in their original condition, including immediate packaging, within the cooling off period.
Our returns policy does not affect your statutory rights. For further information on your statutory rights, see www.consumerdirect.gov.uk.
* Calls are charged at local rate and may be recorded. Our lines are open 9am-6pm Monday to Friday and 9am-5pm on Saturday.
We accept refunds or exchanges of pierced items in original packaging. If you would like to return your purchase please ensure the plastic bag containing your order remains sealed. If the items have been removed from the bag or if the bag has been tampered with, we cannot refund or exchange the item due to hygiene reasons.
Product availability
Our website only shows goods available for purchase in the UK, including Northern Ireland. We are unfortunately unable to despatch goods to addresses outside the UK or in the Channel Islands. However, we do have Ernest Jones stores in Eire, Jersey and Guernsey. For more details on our delivery options, see our Delivery information section.
Some goods on our website are not available to buy online but are available to buy at your local Ernest Jones store. These goods are indicated as such.
Pricing and payment
Prices throughout the website are quoted in Pounds Sterling, and payment can only be accepted in Pounds Sterling. Prices include VAT. Some comparisons to earlier higher selling prices may refer to prices which included VAT at the previous higher rate of 17.5% as opposed to the new lower rate of 15%. Packing and delivery costs will be added to the total price of your goods.
While we make every effort to ensure that the goods shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case. If goods you have ordered are unavailable, you will be notified as soon as possible.
Unless there is a pricing error made on our website or in the ordering process, the price you pay is the price of the goods shown at the time you place the order, even if the price of the goods has since changed.
If a pricing error is made on our website or in the ordering process we will inform you as soon as possible and give you the option of buying the goods at the correct price or cancelling the order. Your order will be cancelled if we cannot get in contact with you to notify you of the error.
Your payment card will be debited for your order on the day that we despatch your goods.
Special Offers Terms & Conditions
Free gift offers valid while stocks last.
If you return an item, under our 30 day cooling off period, with which you received a free gift, you must return both the item you paid for and the free gift. Your legal rights remain unaffected.
Unwanted free gifts are not eligible for exchange or refund. Your legal rights remain unaffected.
Where an offer mentions that an item is reduced in price (for example, half price), the discount will be calculated at checkout before any postage or packaging charges are applied.
Win a Men's Nautica Watch
- The Prize Draw is run by Signet Trading Ltd. Registered office: 15 Golden Square, London, W1F 9JG (the "Promoter").
- Eligibility to enter this Prize Draw is restricted to residents of the UK mainland who are 18 years of age or over. The Prize Draw is not open to employees of Signet Jewelers Ltd, their associated companies or families and friends.
- Participants must subscribe to the newsletter of Signet Trading Ltd in order to enter the Prize Draw. The Prize Draw closes at midnight on Saturday 24 January 2009.
- One winner will be drawn at random within 10 days after the Prize Draw closes and the winner will be notified by email within 28 days after the draw.
- There is one prize to be won and the winner of the Prize Draw will win a Nautica watch (Rose gold men's chronograph watch with black resin strap)
- The Promoter reserves the right to draw an alternative winner in the event that it is reasonably believed that the winner is in breach of these terms and conditions.
- The date on which the winner may claim the Prize (the "Claim Date") shall not be more than 14 days after the notification email has been sent. If the winner fails to respond within this time the Promoter may draw a different winner.
- The Prize is subject to availability. Delivery of the Prize will be within three months of the Claim Date.
- There are no cash alternatives and the Prize is non-transferable.
- Only one entry is permitted per person and per email address.
- By entering the Prize Draw, participants agree:
- to be bound by these terms and conditions;
- that the Promoter may contact them on the details provided with further information about its products and services;
- that their surname and county of residence may be released if they win the Prize;
- that if required to do so, they will provide a photographic ID document (such as passport or driving license) to the Promoter for the purposes of confirming their identity;
- that should they win the prize draw, their name and likeness may be used by the Promoter for such prearranged promotional purposes as the Promoter may reasonably require.
- Participants must have a full UK passport and have at least 6 months validity left until the expiry date and it is the responsibility of the winner to ensure that all members of the party arrange, where necessary, travel insurance and visas at their own expense.
- No purchase is necessary for entry into the Prize Draw.
- You can receive the name of the winner, which will be available from date of the draw, by sending a stamped addressed envelope to: Competition prize draw, Ernest Jones, (Signet Trading Ltd.) Marketing Department, Imperial Place 3, Maxwell Road, Borehamwood WD6 1JN.
- The Promoter reserves the right to amend these terms and conditions and to amend or withdraw the promotion as necessary due to circumstances beyond its control.
- The Promoter excludes liability to the full extent permitted by law for any loss, damage or injury occurring, whether arising in contract, tort (including without limitation negligence), statutory duty or otherwise, to the participant arising from his or her entry into the prize draw or to the winner arising from his or her acceptance of the Prize.
- These terms and conditions are subject to English Law and the jurisdiction of the courts of England and Wales.
Delivery information
- Free Standard delivery applies only to orders between £50 and £150 (including VAT at the UK rate); free Next Day delivery applies only to orders of £150 or more (including VAT at the UK rate) placed on the Ernest Jones website.
- To qualify for free delivery, the total amount of the products purchased after any discount voucher is applied must be between £50 and £150 (Standard) or £150 (Next Day).
- Goods ordered must come to the applicable total before any packing charges are added.
- We reserve the right to change or discontinue free delivery at any time.
- We can deliver to anywhere in the UK, including Northern Ireland. Unfortunately, we cannot deliver online orders to stores or addresses in the Channel Islands or Eire, but you can find stores in these areas.
- If you cancel part of an order, the postage and packaging is recalculated according to the postage rates mentioned above. For example, if you order £75 worth of goods, then cancel a £30 item, your order total will drop below £50, and you will no longer qualify for free delivery.
When will you receive my order?
We will email you as soon as your order has been despatched. If you chose First Class delivery: you will receive your order within 1-2 working days.
If you choose Next Day delivery: you will receive your order the next working day after despatch. If you order after 2pm on a Thursday, your order will be despatched on Friday and should be delivered on the next working day (Monday). If you order after 2pm on a Friday, your order will not be despatched until the following Monday and should be delivered on Tuesday.
Please note that you will need someone to sign and accept delivery of Next Day deliveries.
Store collection
We will email you when your order is packed and ready to be delivered to your chosen store. We will email you again a few days later to let you know that your order is on its way to the store, and will be there in the next 2 days.
Please go to your chosen store to collect your item within 35 days. For your security, the person who placed the order must come to collect the goods with the payment card used to place the order. You should also bring your order number with you.
Faulty goods
The procedures, set out here, to return goods do not affect your statutory rights. Further information on your statutory rights can be found at www.consumerdirect.gov.uk. If you do receive faulty goods, please follow one of the procedures outlined on our returning an item section.
Exclusions
Please note that certain goods cannot be returned unless we are at fault. These are personalised or engraved items.
Returning a gift
Cash refunds for gifts can only be made to the payment card used to purchase the goods. So if you buy a gift online, the recipient will not be able to get a cash refund if they want to return the goods. If a recipient does want to return a gift, we will exchange it for a gift card, credited to the value of the gift, at any Ernest Jones store within the cooling off period.
Changes to Terms & Conditions for buying goods online
We reserve the right to change these Terms & Conditions for buying goods online from time to time. If this happens, we will notify you by posting the new Terms & Conditions for buying goods online on the website. If you do not wish to be governed by the revised Terms & Conditions for buying goods online, you must not place any further orders.
